TicketsCandy respects the intellectual property rights of others and expects users of our platform to do the same.

This Copyright & DMCA Policy explains how copyright owners may report alleged copyright infringement involving content hosted through TicketsCandy, how users may respond to removal of their content, and how TicketsCandy handles repeat copyright infringement.

This policy is part of and should be read together with the TicketsCandy Terms & Conditions and, for event organizers, the TicketsCandy Services Agreement.

1. User-Provided Content

TicketsCandy provides tools that allow event organizers and other users to create event pages and upload or publish content, including photographs, images, graphics, logos, text, videos, and other materials.

Users are responsible for the content they upload, submit, publish, or otherwise make available through TicketsCandy.

By uploading or publishing content through TicketsCandy, you represent that you own the content or have all licenses, permissions, consents, and other rights necessary to use and publish it.

You may not use TicketsCandy to upload, publish, distribute, or otherwise make available content that infringes another person's copyright or other intellectual property rights.

TicketsCandy may remove or disable access to content when we receive a copyright complaint, when we reasonably believe content may infringe third-party rights, when required by law, or as otherwise permitted under our Terms & Conditions or Services Agreement.

2. Reporting Copyright Infringement

If you are a copyright owner, or are authorized to act on behalf of a copyright owner, and believe that material available through TicketsCandy infringes your copyright, you may submit a written notification of claimed infringement under the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512.

To be effective under the DMCA, your notification should include substantially all of the following information:

  1. Your signature. A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work. Identification of the copyrighted work you claim has been infringed. If your notice covers multiple copyrighted works located on a single site, you may provide a representative list of those works.
  3. Identification of the allegedly infringing material. Identification of the material you claim is infringing or is the subject of infringing activity, together with information reasonably sufficient for TicketsCandy to locate the material. Whenever possible, please provide the specific URL where the material appears.
  4. Your contact information. Information reasonably sufficient for TicketsCandy to contact you, such as your name, mailing address, telephone number, and email address.
  5. Good-faith statement. A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy and authority statement. A statement that the information in your notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Notices that do not substantially contain the information required by the DMCA may be incomplete. TicketsCandy may contact the person submitting the notice to request additional information when appropriate.

Please include "DMCA Copyright Notice" in the subject line when submitting a notice by email.

Submitting unrelated customer service requests to the DMCA agent may delay their handling. For general TicketsCandy support questions, please use the appropriate support channels available on our website.

4. What Happens After We Receive a Copyright Notice

When TicketsCandy receives a copyright notice that substantially complies with the DMCA, we may remove or disable access to the material identified in the notice.

TicketsCandy will act expeditiously when removal or disabling of access is required under the DMCA.

When content uploaded by a TicketsCandy user is removed or disabled in response to a DMCA notice, TicketsCandy will take reasonable steps to promptly notify the affected user.

We may provide the affected user with a copy of the copyright notice or information contained in the notice so that the user understands the claim and has an opportunity to respond.

TicketsCandy does not act as a court and generally does not resolve disputes concerning copyright ownership, licensing, fair use, or other copyright defenses between users and copyright claimants.

5. Counter-Notification

If you believe that content you uploaded was removed or disabled because of a mistake or misidentification, you may submit a written DMCA counter-notification to our designated DMCA agent.

To be effective under the DMCA, the counter-notification should include substantially all of the following:

  1. Your signature. Your physical or electronic signature.
  2. Identification of the removed material. Identification of the material that was removed or to which access was disabled, and the location where the material appeared before it was removed or disabled.
  3. Statement under penalty of perjury. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  4. Your contact information and consent to jurisdiction. Your name, address, and telephone number, together with a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located. If your address is outside the United States, you must consent to the jurisdiction of any judicial district in which TicketsCandy may be found. You must also state that you will accept service of process from the person who submitted the original copyright notice or an agent of that person.

Counter-notifications should be sent to the designated DMCA agent listed above.

6. What Happens After a Counter-Notification

If TicketsCandy receives a counter-notification that substantially complies with the DMCA, we will provide a copy of the counter-notification to the person who submitted the original copyright notice.

We will also inform that person that TicketsCandy may restore the removed material or cease disabling access to it.

Subject to the requirements of the DMCA, TicketsCandy may restore the material no less than ten (10) and no more than fourteen (14) business days after receiving a valid counter-notification unless our designated DMCA agent first receives notice from the original complaining party that the party has filed a court action seeking an order restraining the user from engaging in the allegedly infringing activity.

A DMCA counter-notification does not prevent TicketsCandy from removing or restricting content for separate reasons permitted by our Terms & Conditions, Services Agreement, other policies, or applicable law.

7. Repeat Infringer Policy

TicketsCandy has adopted and reasonably implements a policy providing for the termination, in appropriate circumstances, of users and account holders who are repeat copyright infringers.

TicketsCandy may consider relevant circumstances when determining whether a user is a repeat infringer, including:

  • repeated copyright infringement notices involving content uploaded by the same user;
  • repeated removal or disabling of content because of copyright infringement;
  • instances in which TicketsCandy becomes aware of apparent copyright infringement independently of a formal DMCA notice;
  • information provided through counter-notifications or by copyright owners;
  • the nature and seriousness of the alleged infringement;
  • evidence that the user had authorization to use the material; and
  • other relevant facts and circumstances.

Receiving a copyright allegation does not necessarily result in automatic account termination. TicketsCandy may review the circumstances of each matter and determine what action is appropriate.

Depending on the circumstances, TicketsCandy may remove or disable content, issue warnings, restrict an account, suspend events or services, or permanently terminate an account.

TicketsCandy reserves the right to terminate an account immediately in appropriate circumstances, including cases involving repeated, intentional, or serious infringement.

Users whose accounts are terminated for repeat copyright infringement may not create another TicketsCandy account without our permission.

8. Misrepresentations

The DMCA provides consequences for certain knowing material misrepresentations made in copyright notices and counter-notifications.

Before submitting a copyright notice, you should make sure that you have a good-faith basis for claiming infringement and that the use you are reporting is not authorized by the copyright owner, its agent, or the law.

Similarly, users submitting counter-notifications should make sure they have a good-faith basis for claiming that material was removed or disabled because of mistake or misidentification.

A person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled as a result of mistake or misidentification, may be responsible for damages, costs, and attorneys' fees as provided by applicable law.

9. Other Intellectual Property Complaints

This DMCA procedure applies specifically to copyright claims under United States law.

TicketsCandy reserves the right to investigate and take appropriate action regarding intellectual property complaints that do not fall within the formal DMCA process.

10. Standard Technical Measures

TicketsCandy accommodates and does not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works when such measures qualify as standard technical measures under applicable copyright law.

11. Changes to This Policy

TicketsCandy may update this Copyright & DMCA Policy from time to time to reflect changes to our services, procedures, or applicable law.

When we make changes, we will update the "Last Updated" date at the top of this policy.

Your continued use of TicketsCandy after an updated policy becomes effective is subject to the updated policy.
